A trademark protects your brand name, logo or tagline so that nobody else can use it for the same kind of goods or services. We search, file and follow the application until it is registered.

Who it suits

Any business, startup or professional with a name, logo or slogan they want to protect: shops, brands, restaurants, software and apps, and online sellers.

What can be registered

  • Names, words and slogans
  • Logos and device marks
  • Letters, numbers and combinations
  • Colour combinations, packaging shapes and sounds, in some cases

You choose a class (there are 45) for the goods or services you offer. One application is needed for each class.

Documents needed

  • Applicant’s name, address and ID: PAN and Aadhaar for individuals, incorporation papers for companies
  • Logo file, if you want to protect a logo
  • Description of your goods or services
  • Date from which you have been using the mark, if you already use it
  • Power of attorney, which we prepare for your signature
  • Startup or small enterprise proof, if you claim the lower government fee

Our process

  1. 1We run a trademark search to see if a similar mark is already registered or applied for.
  2. 2We choose the correct classes and prepare the application.
  3. 3We file the application and send you the filing receipt.
  4. 4The registry examines the application. If it raises an objection, we reply.
  5. 5The mark is published in the Trademark Journal, and anyone can oppose it within four months.
  6. 6If there is no opposition, the registration certificate is issued.
An application with no objections usually takes about a year to register. Objections or opposition can add months.

After you file

You can use the ™ symbol as soon as you file. Use ® only after the mark is registered, as using it earlier is an offence. A registered trademark lasts ten years and can be renewed every ten years after that.

Common questions

How much does it cost?

There is an official fee for each class, and it is lower for individuals, startups and small enterprises. We quote our charge and the official fee together before we start.

Can I register a name already in use by someone?

If it is the same or similar to an existing mark for the same kind of goods, it may be refused. A search first tells you the risk.

Do I need to register in every class?

Only in the classes where you sell or plan to sell. We suggest the right ones, and we can add classes later.

Is a company name the same as a trademark?

No. Registering a company or domain name does not give you a trademark. Only a trademark registration protects your brand against copying.
