If you live or work across two countries, you can end up taxed twice. We work out where you are taxed, claim treaty relief and keep your reporting clean in both places.

Who it suits

Foreign nationals working in India, Indians who have moved abroad, people returning to India, and families with income or assets in more than one country.

Your residential status

Tax in India depends on your residential status, not your passport. It is decided mainly by the number of days you spend in India. The common categories are:

  • Resident and ordinarily resident: taxed in India on world income
  • Resident but not ordinarily resident: a transition status for those who are new to India or have been away for long
  • Non-resident: taxed in India only on Indian income

Counting a few days wrongly can change your status, so we check your travel dates carefully.

What we help with

  • Working out your residential status each year
  • Tax on salary, perquisites such as housing and cars, and stock options (ESOPs)
  • Tax-equalised contracts and grossing-up
  • Claiming relief under tax treaties and getting the Tax Residency Certificate and Form 10F
  • Reporting foreign assets and income in your Indian return
  • Tax clearance for foreign nationals leaving India
  • Help with US reporting such as FBAR and FATCA for US citizens

Treaties and social security

India has tax treaties with over 90 countries. They can reduce or remove double tax, and some give a short-stay exemption on salary. India also has social security agreements with several countries. These can stop you from paying provident fund in two places and may help you get a refund when you leave.

Documents needed

  • Passport, visa and travel dates
  • Employment contract and salary details
  • Tax Residency Certificate from your home country, if you have it
  • Details of foreign bank accounts, property and investments
  • Previous tax returns of both countries

Common questions

Is rent from a house abroad taxed in India?

If you are a resident and ordinarily resident, yes, world income is taxable in India, with treaty or foreign tax credit relief. Non-residents are usually not taxed in India on it.

Does my employer in India have to deduct tax?

Yes, for work done in India the employer deducts tax from salary, even if part is paid abroad.

What is tax equalisation?

Your employer pays the extra Indian tax so that you pay no more than you would at home. That tax is usually treated as part of your income, and we calculate it.

Can I get my provident fund back when I leave?

In some cases, depending on whether your country has a social security agreement with India. We check this for you.
